sneeze guards

Has anyone successfully managed issues regarding health department requirements for sneeze guards?  We are trying to avoid them (for obvious reasons and really don't believe they are necessary for our set-up) and are looking for strategies to address conversation with health department.

I have heard of places going to every coffee shop in their county and taking pictures of their set up to show that it isn't required to have a sneeze guard.
